A Breif Introduction to Community
Corrections Pilots in China

The speech will bring a brief
introduction of general situation of China’s community correction.
China’s legal system is quite different from the other countries’; few
offenders were sentenced to community correction before. In 1990s, a few
scholars came to pay attention to researches on community correction. In
2002, China started an experiment on implementing community correction
in Beijing and Shanghai. In July 2003, the Supreme Court of the People’s
Republic of China and the Supreme People's Procuratorate use the
expression “community correction” first. In this paper I will narrate
the community correction development in China: notion, objects,
organizations etc. Further, I will discuss some problems existing in
China’s community correction and gives some possible solutions and
discusses how to build legal system fitting for community correction
development.

A Research on Classification Management and Staged
Correction (CMSC) Model

This presentation focuses on CMDE Model
in China’s community correction. Classification Management classifies
the offenders based on their degrees of threat to the society and their
statuses of rehabilitation. Staged Correction divides community
correction to offenders into three stages: correction to new comers,
normal correction and pre-release correction.
The presentation contains four parts: the first part discusses the
objective and significance of the CMSC model; the second part discusses
relevant theories and practices; the third part elaborates practice of
the model; the last part concludes the presentation with overall
evaluation.

Coordination of the Agencies involved in Community
Correction

Since a large member of institutions, including
courts, enforcing agencies, supervising agencies, relevant agencies and
other non-government organizations are working in Community Correction,
it is necessary to coordinate all the agencies involved to make
community correction go more smoothly. Community correction activities
contain penalty enforcing, administration of offenders, rehabilitation
corrections and assistances to offenders; therefore how to improve the
agencies and their activities involved in community correction is a big
issue. We should coordinate all the agencies, coordinate law enforcement
activities, improve the community correction network, and standardize
the community activities involved in community correction.

Methods and measures in
community correction

In this speech, I will
give a introduction to the general situation of pilot projects of
community correction in Jiangsu province. Further, I will report the
methods and measures we adopted in community correction from following
aspects: enhance the coordination between courts, prisons, jails, and
local police stations to lay a firm foundation to community correction;
design different project to individual according to offender’s
characters and supervising them under routing life; supervise the
offenders in terms of observing national law, regulation, and
supervision, and accepting psychological treatment; adopt different
plans according to the correction stage of an offender; help offenders
to solve their problems in daily life, provide job training, offer
allowance to ensure their basic life; and establish a detailed set of
regulations and make the offenders well know what kind of behaviors are
encourages and what kind of behaviors should be punished to keep
community correction running well.

Professional Training to Social Workers in
Community Correction — Shanghai as an example

China
is now developing Community Correction with the purpose of preventing
crimes and reducing the number of criminals. The current work which is
also the essential work is to form a professional and effective team of
Social Workers, including staff and volunteers. Taking Shanghai as an
example, this report elaborates the experiences of professional training
to social workers in Shanghai. In practice, we advise to follow the
model consisted of four factors: centralized training, superintendence
of experts, self-training and mutual supervision. The training should
focus on both execution of punishments and services provided to
offenders.

The Pros and Cons of Community Correction

Community Correction is a way and measurement to make up the defect of
incarceration to offenders, so it is necessary to study and research how
to improve the effect and which elements are the pivotal content to make
community correction successful. According to our experiences of pilot
projects in community correction, the internal and external factors
should be concerned. The external factors include construction of
community correction, social security and community policing; the
internal factors include construction of the organization structure,
mobilization of social resources, design and implement of community
correction project, protection of law, and financial support. At the end
of this speech, I will emphasize the way of working in community
correction. Community correction should be treated as a system project.
All social recourses, community personnel should be involved and be
brought into full play to help the offenders return to normal society.

Community Correction in China

The thesis has two parts, part one shows institution
background, part two is about value tendency.
In part
one, first section says that the conceptions of criminal in China
always refer to two kinds of factors: characters of crimes and
degree of dangerous (related to the historical measures of managing
state affairs). In the field of criminal justice, the situation is
that punishment is serious, but the range of jurisdiction is very
narrow (reduced criminals who should be punished). In the second
section, I will describe that some criminals were very dangerous to
society, so they must be send into prison. Related to the actual
practice, the cost of incarceration is very high but ineffective.
In part two, first section is about current situation of
non-custodial penalties in China: we have gotten a certain extent of
development, but problem still exists, especially the problem that
criminals are out of control. Since there are several agencies
handle it but they have no effective ways to work together. Second
section introduces the basic target of the revolution of punishment
system: increasing the proportion of non-custodial penalties
(community correction), developing the system of executive
punishment, and set up a central agency to handle all affairs.
